A venture capital group
wanted to invest in an invention relating
to a pharmaceutical formulation for improved
delivery to specific organ of the body.
A patent application was already filed for
the same and venture capital group wanted
the innovator company to provide them with
the evaluation of patentability potential
and strengths of the invention. We performed
a comprehensive search in various patent
and non-patent databases to locate prior
art documents that may anticipate or render
the invention obvious and thereby non-patentable.
Our searches did not reveal any materially
relevant prior art. We also examined the
search report of International Search Authority,
which cited only a single patent document
that too related to a general state of the
art and not of particular relevance. This
further substantiated our findings of high
patentability potential of the invention.
We further analyzed the claims and suggested
amendments to rectify certain errors. Additionally,
we also reviewed all documents including
official correspondences with Patent Offices
for filing of the patent application and
ascertained that there were no lacunas.
We provided a detailed report including
our various findings with remarks. Our positive
findings with regard to the high patentability
potential gave confidence to the innovator
company to attract funding.
Before launching a product
relating to a wearable medical device, a
company wanted to discover any third party
patents that they may infringe and also
likely infringement of their patent rights
by others. We conducted a freedom-to-operate
search in two jurisdictions of their interest
where they intended to launch their product.
We identified the closest relevant prior
art documents, analyzed the claims and prepared
the claim charts, which illustrated that
their product was less likely to infringe
the existing patents. Also, we obtained
and studied the file wrapper for prosecution
history of their issued patent and discovered
that the patent examiner did not cite any
prior art document. Also, the ones cited
by the applicant himself were not relevant
to patentability of his invention. We provided
the detailed report of our findings to the
company. Further, we carried out the searches
post filing date of the company’s
patent and we also did the citation analysis.
We identified the inventions close to the
patents and reported the same to the company.
This not only helped them to identify the
potential infringers but also gave them
insight about their probable competitors.
An automotive company
wanted to invest and introduce the latest
components into their automobiles. We conducted
patent data mining for each component of
their interest, carried out landscape analysis
and provided statistical and technical analysis
with many tabular and graphical representations.
Our elucidative reports helped the company
including their technical staff and management
to know about the components right from
the start to the latest developments for
the same, the key players leading the latest
developments. With such analyses they were
able to focus and strategies their investment
into development of new components and acquire
or license some of the inventions relating
to such components of their interest.
